2. From whom do we collect Personal Data?
We process Personal Data about you as a visitor to our website.
Our website does not intend to collect data on website visitors who are under the age of 18, unless they have permission from their parents or guardian. However, we cannot verify whether a visitor is over 18 years old. We therefore advise parents to be involved in their children's online activities in order to prevent the collection of Personal Data about children without parental consent. If you believe that we have collected Personal Data on a minor without such consent, please contact us immediately at info@nexiosfoundation.eu.
5. What do we use your Personal Data for and with what legal basis?
We will use the Personal Data communicated by you on the basis of our legitimate interest in order to, inter alia:
- answering any questions you might ask us via the website;
- improve the use of the website;
- to provide you with a better experience when using our website.
We may also use your Personal Data to combat fraud and breaches, and manage disputes and litigation and do so on the basis of our legitimate interest to detect and curb fraud and breaches, as well as inadmissible or unlawful statements, to secure our IT systems, and to conduct litigation.
We may also use your Personal Data to comply with our legal obligations to which we are subject or for.
We also refer to our Fundraising Privacy Statement which specifically sets out the purposes and legal basis for which we process Personal Data in the context of fundraising and the donations you make to us.
6. Who has access to your Personal Data?
Your Personal Data are processed by our own employees. All our employees have an obligation of confidentiality and they may only process those Personal Data that are necessary for the performance of their duties.
Below you will find a list of the persons who have access to your Personal Data.
Service Providers
We work closely with third-party service providers, such as IT service providers, so that we can provide you with a quality functioning website. These service providers may access your Personal Data to the extent necessary to assist us in performing these services. Where third parties process your Personal Data on our behalf, we will enter into appropriate contractual arrangements with them to ensure that they only process your Personal Data in accordance with Nexios Foundation's instructions and in compliance with the AVG and the GBW, including implementing adequate security measures.
Disputes
We may also disclose your Personal Data to third parties who assist us in the context of any disputes and litigation, such as the liability insurer or lawyers and bailiffs.
Restructuring
We may also disclose your Personal Data to third parties in the context of a possible acquisition, restructuring or conversion of Nexios Foundation, such as to prospective purchasers associations, other foundations, universities or legal persons governed by public law that pursue the disinterested purpose of Nexios Foundation or a purpose that would be as close as possible to it with whom we could merge, or who would take over all or part of our activities.
Legal Obligations
Finally, we may also disclose your Personal Data to governments or judicial authorities if we would be legally obliged to do so.
Outside the cases set out in this section 4, your Personal Data will not be disclosed to third parties. If we do intend to do so, we will inform you (see also our Privacy Statement on Fundraising) or, if necessary, obtain your consent. However, we may process and disclose anonymous or aggregated data to third parties.
8. How long will your Personal Data be kept?
For data retention periods via cookies, please refer to our Cookie policy. For Personal Data we collect when you interact with us (e.g. when contacting us via the contact form), we will retain your Personal Data for up to 10 years after you have actively expressed your interest in Nexios Foundation in any way. For further principles on retention periods, please refer to our Fundraising Privacy Statement.
Where we are required by law to retain certain types of Personal Data for specified legal periods, we will comply with those periods.
9. Your rights
In accordance with the AVG, as a data subject you can exercise various rights in relation to the Personal Data we process about you. This is further explained below.
Right of inspection and copy
Inspection - You have the right to inspect the Personal Data we process about you free of charge at any time, unless and to the extent such inspection is precluded by law.
You also have the right to receive certain information about this processing. Specifically, you are entitled to the following information:
- the existence or non-existence of processing operations on the Personal Data;
- the Personal Data itself;
- the purposes of the processing of this Personal Data;
- the categories of Personal Data and their retention period;
- the categories of recipients to whom this Personal Data is disclosed;
- the rights in respect of this Personal Data;
- the source of this Personal Data, if it was not collected from yourself;
- the existence of automated decision-making based on this Personal Data, as well as the underlying logic and consequences of such decision-making.
Copy - You also have the right to obtain a copy of your Personal Data free of charge, to the extent that you are entitled to view it in accordance with the AVG. If you require multiple copies of the same information, Nexios Foundation reserves the right to charge a fee for administrative costs for this purpose.
Right of rectification
You also have the right to have any inaccurate or incomplete Personal Data processed corrected or supplemented free of charge. If we determine that the Personal Data are indeed incorrect or incomplete, they will be corrected or supplemented.
You may also hereby request that Personal Data be temporarily not further processed (except in some legally defined cases) until the accuracy or completeness of the Personal Data has been checked and any inaccuracies/incompleteness rectified (except in some legally defined cases). Please refer to the section “right to restricted processing“ in this regard.
TransferabilityRight
You further have the right within certain limits determined by the AVG to request us to transfer a copy of your Personal Data in a machine-readable format (e.g. XML) to you and/or directly to another institution or person of your choice. However, this right only applies to Personal Data that you have provided to us yourself.
Right to withdraw consent
If you have given us consent to a particular processing of your Personal Data, you always have the right to withdraw your consent. We will then no longer process the Personal Data. However, this does not affect the lawfulness of the processing prior to the withdrawal of your consent.
Right to oppose processing
Where we process Personal Data about you based on our legitimate interest, you may in certain cases object to such processing.
However, if the processing is not a form of direct marketing, we may still continue processing your Personal Data where this is necessary for compelling legitimate reasons. Pending the assessment of these reasons, however, you may request us temporarily not to continue processing the Personal Data concerned (except in some legally defined cases). Right to removal
If you believe that your Personal Data should no longer be processed (e.g. because it is no longer necessary or is being processed unlawfully), you may request that your Personal Data be permanently deleted from our files.
However, as a Controller, we are not obliged to delete Personal Data if it may or should still be lawfully processed in accordance with the AVG.
Right to restricted processing
In certain cases, you have the right to request that your Personal Data, while still retained by us, is temporarily not further processed. Apart from the cases mentioned under the rights to rectification, opposition and deletion in this Privacy Notice, you also have this right if we no longer need the Personal Data, but you yourself still need it in the context of a legal claim.
However, in some legally defined cases, the restricted processing does not apply and we may still process your Personal Data. These cases are the following:
- if you yourself have given your specific consent to a particular processing;
- if Nexios Foundation itself needs the Personal Data in the context of a legal claim;
- if the Personal Data need to be processed in order to protect the rights of another natural person or legal entity; or
- for important public interest reasons.

Verification - If your request is unclear or if there are doubts about the identity of the person seeking to exercise the rights on your behalf, we may request the necessary additional information. If the applicant refuses to provide the necessary information, we may refuse the request.
Handling period - After submitting your request, you will receive an acknowledgement of receipt and we will let you know as soon as possible and at the latest within one month what action will be taken on the request. In the case of complex or multiple requests, this period may be extended to three months after submission of the request. In that case, we will inform you accordingly.
Costlessness - This request procedure is in principle completely free of charge. However, if your request is manifestly unfounded or if you make excessive use of your rights, in particular by making similar requests excessively repetitive, we are entitled to refuse these requests or to charge a reasonable fee to cover administrative costs.

Complaints - If You believe that the provisions of this Privacy Statement or of the AVG are not being complied with, You can always lodge a complaint with the Data Protection Authority (via e-mail to contact@apd-gba.be or by letter (Drukpersstraat 35, 1000 Brussels). If you have complaints, please submit them to us first so that a solution can be sought.
10. Security measures to prevent the loss, misuse or alteration of your Personal Data
We use security measures to protect your Personal Data from access by unauthorised persons and from unlawful processing, accidental loss, destruction and its corruption.
However, information transmitted over the internet can never be 100% secure. As a result, we cannot guarantee the security of the information you transmit to us. Once we receive the information, we make every effort to ensure the security of our systems.
